RENTAL AGREEMENT & WAIVER

At Hoop Fresno, we bring high-energy fun straight to your event. For everyone’s safety and enjoyment, please review the following Terms & Conditions and Liability Waiver carefully.

This agreement is entered into between Hoop Fresno LLC (“Company”) and the undersigned client (“Renter”) for the rental and use of a mobile arcade basketball trailer and related equipment.

1. SERVICES

Hoop Fresno provides mobile basketball entertainment equipment and related services (“Equipment”) for private and public events. Services include delivery, setup, removal, and limited operational instruction.

a.     Trailer Rental Includes:

      i.         4 Arcade Basketball Machines

    ii.         (20) Basketballs

   iii.         (1) Bluetooth Sound System

   iv.         LED Party-Style Lights

     v.         (1) Fog Machine

   vi.         Generator OR 50/100ft Power Cord Depending On Requested Power Source

Unless expressly agreed prior to the event, Hoop Fresno may not provide ongoing supervision during the event. The Renter remains solely responsible for participant conduct and safety.

2. BOOKING & PAYMENT

  • A deposit payment of 50% is required at the time of booking unless otherwise agreed in writing.

  • The remaining balance must be paid within 3 days of your event.

  • A booking is not confirmed until payment has been successfully processed.

  • All prices at checkout have already included online payment fees.

  • Hoop Fresno reserves the right to refuse or cancel bookings at its discretion.

3. DELIVERY & SETUP REQUIREMENTS

  • Customer must provide a safe, level, and unobstructed area suitable for Equipment setup and use.

  • Trailer space required – 20’X8.5’X10’ (Length X Width X Height in Feet)

  • Adequate access for delivery vehicles must be available at the scheduled time.

  • If setup requirements are not met upon arrival, Hoop Fresno may cancel the booking without refund.

Delivery fees, if applicable, are disclosed following booking and are based on event location. A fee of $2.00 per mile will apply if the event is outside a 20 mile radius of Fresno. Any event beyond a 50 mile radius is subject to special booking requirements.

4. RENTER RESPONSIBILITY

Renter agrees to:

  • Supervise all participants and ensure Equipment is used safely and only as intended

  • Follow any verbal or written instructions provided by Hoop Fresno

  • Prevent unsafe, reckless, or inappropriate use of the Equipment

  • Return the Equipment in the same condition as delivered, normal wear and tear on basketballs excepted

Customer is responsible for any damage, loss, theft, or vandalism to the Equipment occurring during the rental period due to negligence, misuse, or failure to supervise.

5. PAYMENT, CANCELLATION & REFUNDS

  • Full payment is required prior to event.

  • Cancellation policies are determined on a as needed basis and can be discussed following booking.

  • Deposits are non-refundable unless otherwise discussed.

  • If the need to cancel or rebook occurs the deposit will be credited towards a future booking (must be used within the current calendar year).

6. DAMAGE, LOSS & MISUSE

Renter is financially responsible for any damage, theft, or vandalism to the Hoop Trailer caused by misuse, negligence, or failure to follow rules, excluding normal wear to the basketballs. Repair replacement cost may be charged to the renter.

7.  ASSUMPTION OF RISK

a.      Customer acknowledges that participation in basketball activities and use of the Equipment involves inherent risks, including the risk of personal injury, property damage, or loss.

b.     Customer voluntarily assumes all such risks on behalf of themselves and all participants, whether such risks are known or unknown, foreseeable or unforeseeable.

8. RELEASE OF LIABILITY

To the fullest extent permitted by California law, Renter, on behalf of themselves and all participants, guest, invitees, heirs, and assigns, hereby releases, waives and discharges Hoop Fresno its owners, officers, employees, contractors, volunteers, and agents from any and all claims, demands, damages, actions, or causes of action arising out of or related to:

  • Personal Injury

  • Property Damage

  • Loss or theft

  • Illness

  • Death

resulting from the use or participation in the mobile arcade basketball trailer, except where caused by the gross negligence or willful misconduct of Hoop Fresno.

9. SUPERVISION & SAFE USE

  • Adult supervision is required at all times.

  • Renter is responsible for ensuring that all participants follow safety rules and instructions provided by Hoop Fresno.

  • No climbing, hanging, standing, rough play or misuse of equipment is permitted.

  • Participants must be physically capable of safely participating.

Hoop Fresno reserves the right to pause or stop play immediately if unsafe behavior occurs, without refund.

10. USE BY MINORS

Renter represents that they are the parent or legal guardian of any minor participants, or that proper parental consent has been obtained. Renter assumes full responsibility for minors using the equipment.

11. MEDIA RELEASE

Customer grants Hoop Fresno permission to capture and use photographs and video recordings taken during the event for promotional and marketing purposes, including online and social media, without compensation.

Customer must notify Hoop Fresno in advance if any participant does not wish to be photographed or recorded.

12. WEATHER & SITE CONDITIONS

  • Renter is responsible for providing a safe, level, and accessible setup location.

  • Hoop Fresno may delay, suspend, or cancel operation due to unsafe weather conditions (including but not limited to rain, high winds, extreme heat, or lightening).

13. SLUSHY MACHINE RENTAL TERMS (OPTIONAL ADD-ON)

If a slushy is rented as part of the event, Renter agrees to the following:

  • Only adults may operate the slushy machine unless otherwise approved.

  • Machine must remain on a stable, dry surface way from water and weather exposure.

  • Renter is responsible for preventing tipping, spills, or electrical hazards.

  • No foreign substances may be placed into the machine unless otherwise approved.

  • Renter is responsible for disposal of remaining substance following event.

14. BACKYARD GAME RENTAL TERMS (OPTIONAL ADD-ON)

Backyard games may include, but are not limited to, corn hole, giant Jenga, yard pong, or similar games.

  • Games must be used only as intended.

  • No standing, climbing, throwing, or misuse of game components.

  • Games must be kept away from fire, pools, or hazardous areas.

    Renter is financially responsible for any lost, broken, or excessively damaged game equipment.

15. INDEMNIFICATION

Customer agrees to indemnify, defend, and hold harmless Hoop Fresno from and against any claims, liabilities, damages, costs, and expenses (including legal fees) arising from:

  1. Customer’s breach of these Terms

  2. Acts or omissions of Customer or event participants

  3. Claims brought by participants or third parties related to the event or Equipment

This obligation survives the completion of the rental period.

16. SEVERABILITY

If any provision of these Terms & Agreements is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17. GOVERNING LAW

This Agreement shall be governed by and constructed in accordance with the laws of California.

18. AGREEMENT

By booking Hoop Fresno, the Customer confirms they have read, understand, and voluntarily agree to all Terms & Conditions stated above.
